Introduction

Welcome to Luma Learn. These Terms of Use ("Terms") explain the rules for using the Luma Learn learning platform, which includes our WhatsApp service (078 785 8164) and the website www.lumalearn.ai (together, the "Platform"). By accessing or using the Platform you agree to these Terms. If you do not agree, please do not use the Platform.

Luma Learn provides educational content, study materials, and AI-assisted learning tools to help learners (Grades 1–12), parents, and teachers. Our goal is to make learning accessible and practical but the Platform is provided for educational purposes only and must be used responsibly.

These Terms work together with our Privacy Policy, available on the Platform, which explains how we collect, use, and protect personal information.

Terms and Conditions of Use

By using Luma Learn, you agree to follow these Terms and any updates we make to them from time to time.

Luma Learn may update or change these Terms without prior notice. Any updates will be shared through our website or WhatsApp channel. Continued use of the Platform after changes are made means that you accept the new Terms.

These Terms apply to all users including learners, parents, teachers, and schools who access or use the Luma Learn Platform in any way.

If a learner is under 18 years old, their parent or guardian must give permission for them to use Luma Learn and agree to these Terms on their behalf.

Luma Learn provides educational support tools, but we are not a formal school or accredited institution. The Platform should be used as a supplement to formal education, not a replacement.

Who Can Use Luma Learn

Luma Learn is designed for learners in Grades 1–12, as well as parents, teachers, and schools who wish to support education through our Platform.

To use Luma Learn, you must:

• Have access to WhatsApp or the internet;
• Provide accurate and truthful information when signing up; and
• Use the Platform for lawful, educational purposes only.

Learners under the age of 18 must have permission from a parent or guardian before using Luma Learn. By allowing a child to use the Platform, the parent or guardian agrees to these Terms and takes responsibility for the child's use of the service.

Luma Learn reserves the right to restrict or suspend access to users who misuse the Platform or violate these Terms.

Using the Platform

Luma Learn provides educational materials, past papers, summaries, and AI-powered learning support through WhatsApp and our website www.lumalearn.ai.

When using the Platform, you agree to:

• Use it only for educational and non-commercial purposes;
• Provide accurate information when signing up or engaging with Luma Learn;
• Follow all instructions and guidelines shared on the Platform; and
• Treat other users, staff, and partners with respect and courtesy.

You may not:

• Use Luma Learn for unlawful or harmful purposes;
• Upload or share offensive, misleading, or inappropriate content;
• Attempt to disrupt or damage the Platform, its data, or other users' experience; or
• Misuse the AI assistant by asking or sharing information unrelated to learning or education.

Luma Learn aims to provide uninterrupted access to learning materials, but we cannot guarantee that the Platform will always be available, error-free, or compatible with all devices.

Accounts and Access

Luma Learn can be accessed through WhatsApp (078 785 8164) or via our website at www.lumalearn.ai.

When signing up, users may be asked to provide basic information such as their first name, grade, school, province, language, and subjects. This information helps us personalise the learning experience.

By using the Platform, you agree to:

• Keep your WhatsApp account secure and not share it with others;
• Only use your own details when registering; and
• Notify us if you believe someone is misusing your account or pretending to be you.

Luma Learn reserves the right to suspend or remove access if we detect misuse, suspicious activity, or any behaviour that goes against these Terms or South African law.

We may also occasionally perform maintenance or updates that could affect access. We'll always do our best to keep interruptions to a minimum.

Privacy and Data Protection

Luma Learn values your privacy and follows South Africa's Protection of Personal Information Act (POPIA).

When using the Platform, we collect only the basic information needed to deliver our learning services, such as your phone number, first name, grade, school, province, language, and subjects.

All personal information is anonymised after collection. This means we remove names and contact details before using data for reporting, research, or improving our services.

We do not sell, share, or disclose identifiable personal information to third parties.

By using Luma Learn, you agree to the terms of our Privacy Policy, which explains in more detail how we collect, store, and protect user data.

User Conduct (Viruses, Hacking and Other Offences)

All users are expected to use Luma Learn responsibly and respectfully. You may not use the Platform in any way that could harm others or damage our systems.

You must not:

• Attempt to gain unauthorised access to the Platform, its servers, or any connected systems;
• Upload, share, or send any harmful software, virus, or malicious code;
• Try to interfere with the normal operation of Luma Learn;
• Collect or use information from other users without their consent; or
• Use automated systems, bots, or scripts to access or disrupt the Platform.

If any of these actions are detected, Luma Learn may immediately suspend access, report the matter to authorities, and take appropriate legal steps.

We work hard to keep our systems safe, but we cannot guarantee that the Platform will always be free from viruses or other harmful components. Users should ensure their own devices have up-to-date antivirus protection.

Luma's Intellectual Property

All content, materials, and resources available on the Luma Learn Platform, including text, graphics, videos, learning materials, software, logos, and the Luma Learn name, are the intellectual property of Luma Learn or Third Parties, and are protected under South African copyright and trademark laws.

Users may use Luma Learn content only for personal educational purposes. You may not:

• Copy, distribute, or reproduce any Luma Learn content without permission;
• Modify, sell, or publish any part of the Platform's materials; or
• Claim ownership of any content or brand elements belonging to Luma Learn.

Any unauthorised use of Luma Learn's intellectual property may result in legal action or suspension of access to the Platform.

Disclaimers

Luma Learn uses artificial intelligence (AI) to provide educational support, explanations, and resources to learners, parents, and teachers. While we strive for accuracy and helpfulness, Luma Learn cannot guarantee that every answer, explanation, or resource provided by the AI will be 100% correct or complete.

The information on the Luma Learn Platform is intended for educational purposes only and should not replace teacher guidance, textbooks, or official curriculum materials.

Luma Learn is not responsible for any errors, omissions, or outcomes that may result from reliance on the information or tools provided through the Platform. Users are encouraged to verify information with official school resources where necessary.

By using Luma Learn, you acknowledge and accept that responses generated by AI may vary and are provided "as is" without any warranties, either express or implied.

Limitation of Liability

To the fullest extent permitted by law, Luma Learn will not be liable for:

• Any loss, damage, or expense arising from the use of the Platform;
• Any errors, inaccuracies, or omissions in content provided by the Platform, including AI-generated answers;
• Any indirect, incidental, special, or consequential losses, including lost data or lost opportunities; or
• Any reliance on educational guidance provided through the Platform.

Luma Learn provides the Platform as is for educational purposes, and users agree that their use of the Platform is at their own risk.

Parents, guardians, and teachers are responsible for supervising learners and ensuring that educational guidance is interpreted appropriately.

Events Outside Our Control

Luma Learn is not responsible for any delays, interruptions, or failures in the Platform caused by events beyond our reasonable control, including but not limited to:

• Technical failures, outages, or connectivity issues with WhatsApp or the internet;
• Natural disasters, power outages, or extreme weather;
• Strikes, labor disputes, or civil unrest; or
• Any other events outside Luma Learn's reasonable control ("force majeure").

In such cases, we will make reasonable efforts to restore services as soon as possible, but users acknowledge that access to the Platform may be temporarily affected.

Governing Law

These Terms of Use are governed by and interpreted in accordance with the laws of South Africa.

By using the Luma Learn Platform, you agree that any disputes or claims arising from your use of the Platform will be subject to the exclusive jurisdiction of the South African courts.

This ensures that all users, parents, guardians, and institutions are aware that South African law applies to their use of Luma Learn.

Termination

Luma Learn may suspend or terminate your access to the Platform at any time, without notice, if:

• You violate these Terms of Use;
• You misuse the Platform, interfere with its operation, or engage in unlawful activity; or
• Luma Learn believes it is necessary to protect other users, staff, or the integrity of the Platform.

Users may also stop using the Platform at any time.

Upon termination, your access to the Platform will end, but any anonymised data collected prior to termination may still be used by Luma Learn for reporting, research, or service improvement, in accordance with our Privacy Policy.
